Training for lawyers in Kutaisi

On 13-14 March a training “How to apply to the Constitutional Court” was held for practicing lawyers of the Imereti region in Kutaisi, Hotel “Imeri”. Main topic of the training were the forms and procedures of application to the Constitutional Courts, the litigation in the above court and etc. The agenda of the meeting included such issues as adoption of the decisions by the court, enforcement of the judgments and so forth. As an examples, a number of important judgments were discussed. The participants were given a moot court exercise, in the frames of which they prepared a constitutional claim and observation, elaborated recommendations and memorandum of co-operation.

"Article 42 of the Constitution“ won another two cases in the European Court

On 13 January 2009 the Eropean Court of Human Rights made public two new judgments against Georgia. In cases „Abdul Hamid Aliev v. Georgia“ and „Nikolaishvili v. Georgia“ the applicants were represented by „Article 42 of the Constitution“. In case „Abdul Hamid Aliev v. Georgia“ the Court found that the government of Georgia violated article 3 of the Convention with respect to the applicant. The latter article prohibits torture, inhuman or degrading treatment or punishment.

“Article 42 of the Constitution” lodges a new constitutional claim before the constitutional court

Lawyers of the organization “Article 42 of the Constitution” brought a claim before the constitutional court against parliament of Georgia. The organization requests the court to declare some provisions of article 84 of the Code of the Criminal Proceeding (CCP), paragraph 3, subparagraphs “o” and “f” unconstitutional. Subparagraph “o” of article 84.3 stipulates that the lawyer has a right to get familiar with case materials and make copies only after the case together with the indictment is submitted to the court. Thus the lawyer of the defendant does not have a right to make copies of the case materials, whereas the prosecution can enjoy this right without any restrictions.

Lawyers involved in litigation of cases in the ECHR had a meeting in Kutaisi

A meeting of a network of practicing lawyers, who work on the cases that are pending before the European Court of Human Rights was held in Kutaisi, Human Right House on 6 December. Practicing lawyers of the Western Georgia discussed the problems related to the application procedures to the ECHR and litigation of the cases. Lawyers, together with the experts of the organization «Article 42 of the Constitution» held discussion on important issues, such as lodging an application in the European Court of Human Rights; prohibition of torture, right to life and fair trial – standards of the ECHR and case-law of Georgia in this relation; judgments of the European Court.

New initiative of Public Defender of Georgia, organization “Article 42 of the Constitution” and “Georgian Network of Reducing the Damage”

On 1st December, World AIDS Day, Public Defender of Georgia, organization “Article 42 of the Constitution” and “Georgian Network of Reducing the Damage” presented a new initiative to the society. In the office of the Public Defender a memorandum of co-operation in combating HIV/AIDS and support to the HIV infected persons was elaborated and concluded. Memorandum is open for signature for any individual or organization who is willing of and capable to make a contribution towards a common objective of providing assistance to HIV infected persons and combatting HIV/AIDS.

Who is liable when a civilian becomes a victim of a land mine explosion

After announcement of independence of Georgia, an issue of demolition of Russian military bases and demobilization of Russian troops arose. This process was protracted in time and life and health of a number of civilians were lost during the process. The reason was that all military bases were mined during the time that they functioned in order to minimize the chances of unauthorized access. After the bases were abandoned by the military forces, necessary measures were not taken to demine the territory.

Right to property according to the judgments of the Constitutional Court

Right to property is one of the fundamental human rights. It is guaranteed by article 21.1 of the Constitution. The above article states that “Right to property and inheritance is recognized and ensured. It is prohibited to abolish the universal right to property, right to purchase, sell or inherit a property”.
Ensuring the right to property first of all means securing right of each owner to protect himself from unjustified interference of the State, in particular through access to the Court.
